Typically, a DUI stop is effected by law enforcement when some minor traffic infraction is alleged to have been committed. If the officer suspects the driver to be under the influence, he or she will usually request the performance of several field sobriety tests. Afterward, a PAS test, or a preliminary alcohol screening device, is usually administered to the driver. If the results of the PAS test are at a .08 blood level alcohol or greater, the officer will usually arrest the driver and transport him or her to the local county jail.
Once at the jail, the driver should be given a choice of taking either a blood or breath test to determine his or her blood alcohol content. At this point, the driver cannot refuse to take the chemical test, and criminal enhancements may be effected for refusing to do so. However, the police may not forcefully take a breath test or blood draw unless done under safe, medically approved procedures.
From there, a future court date will be given to the driver, and law enforcement will submit a police report to the local District Attorney's Office for a DUI prosecution.
